    LRHUDA 1993 – collective enfranchisement – restrictive covenants – development value of converting from flats to house – s. 61 break rights.

    In this appeal relating to a collective enfranchisement claim, the LC had to consider (i) whether to impose a restrictive covenant in the freehold transfer of a house which would prevent it being developed from flats into a single residence at the term date, and if not, (ii) how the development opportunity should be valued.
     
    In considering the second point, the Tribunal also gave guidance on how s. 61 break rights work and how the compensation, payable on such a break, is calculated.

    This case involved four consolidated appeals against decisions of the Midlands Leasehold Valuation Tribunal which determined the premiums payable for extended leases on 5 properties in the West Midlands, under the provisions of section 48 of the Leasehold Reform, Housing and Urban Development Act 1993. 

    The decision considers the use of graphs based on previous LVT decisions.

    This appeal concerned a lease extension of a maisonette flat. The points in issue were: the LVT’s decision on relativity; the LVT’s decision on the freehold vacant possession value of the Flat; whether the LC could award more than the freeholder had contended for in front of the LVT.

    This case looks at the landlord's ability to carry out works after service of a notice. Held there was no statutory duty not to carry out the works, but the particular works in question were a substantial interference with an easement to enjoy a garden enjoyed by the tenants. I have added a comment at the end about the broader position.

    The main import of this case is that the President of the Lands Chamber called for a change in valuation practice under the LRA 1967 making the inclusion of Haresign addition the standard or default model. The case also clarifies how the slip rule applies to the LVT (i.e. in the same way as it applies normally) but also points out that there will soon be a wider power to review decisions introduced.
