Tim practices in the areas of property law and business & commercial law.
He regularly appears in the County Court and the High Court. He has experience of the Leasehold Valution Tribunal and hearings before the Adjudicator to HM Land Registry.
He undertakes drafting as well as written and telephone advices in the areas of law in which he specialises.
Experience
Property
Real Property: Tim acts in and advises upon claims involving adverse possession, easements and rights of way, mortgages, freehold and leasehold covenants, licences, boundary disputes, and claims to beneficial interests arising out of resulting trusts, constructive trusts and proprietary estoppel.
Landlord & Tenant: Tim specialises in both commercial and residential landlord and tenant law, acting for both landlords and tenants. He acts in and advises upon claims involving all aspects of possession, the effect of insolvency upon possession proceedings, succession, matters relating to anti-social behaviour (to include commital proceedings following breach of anti-social behaviour injunctions), disrepair, dilapidations, service charges, renewal of business tenancies, and enfranchisement.
Business & Commercial
Commercial: Tim acts in and advises upon general contractual claims (to include building contracts), debt enforcement actions (such as charging orders and third party debt orders) and proceedings for interim relief (such as freezing injunctions). Tim has acted as Junior Counsel in high value Commercial Court and arbitration claims. He has experience of arbitration under the rules of London Court of International Arbitration and challenges/appeals to the High Court in arbitration proceedings.
(1) Savage (2) Walding v Singh & 3 Others (2009) Eight day multi-party trial relating to a landlord's obligation to insure a property and pay out insurance monies for reconstruction following a premises fire. Fraudulent misrepresentation by original assignor landlord. Claims for damages and indemnities by successor landlord.
Celtic Resources v Arduina Holdings [2006] EWHC 2553 (Comm) Consideration of whether there was a real risk of dissipation of assets before continuing a freezing injunction.
